Nosferatu - The Movie IP and your Gothic Designs with the Keyword - Nosferatu

I just love all things gothic. I have a massive amount of Nosferatu - Halloween stuff. Now I can see that there is a new film and I’m worried that Zazzle will be nervous about IP.

So here’s the lowdown:
“Nosferatu,” translates to “offensive one”. The term “Nosferatu” originates from the 1922 silent film - an unauthorized adaptation of Bram Stoker’s “Dracula.” Legal challenges from Bram Stoker’s estate demanded all the copies to be destroyed but some were not and the film entered the public domain. The recent release of a remake does not change its public domain status. So, as long as my designs are based on the original “Nosferatu” there should not be any new copyright issues.

And you know of course Z is ALWAYS going to er on the side of caution so I imagine they will be watching this very closely and the AI bots will likely be heavy on the delete button.

Yes that is what I am thinking. So I may have to go through all my designs and remove keywords and the term in the description and title. It would be good if Zazzle could come forward with what they plan to do before I get my work deleted.

Interesting. I didn’t know the history behind Nosferatu & Dracula. But while that old film is public domain, the name Nosferatu has several live trademarks on it from different parties, when used with beer, wine, perfumes,

men’s, women’s, and children’s wearing apparel, namely, shirts, T-shirts, sweatshirts, jackets, coats, vests, dresses, skirts, pants, shorts, jeans, underwear, scarves, bandannas, ties, caps, hats, belts, caps, footwear and headwear

And

Printed and literary matter, namely, books, pamphlets, labels, paper tags, in the subject of medieval, gothic, horror and romance stories; posters; [unmounted photographs; paintings;] art prints; [temporary tattoos;] bumper stickers; stationary; greeting cards; decals; and stickers

so you are right in that the word in tags/title may get your products pulled even if they’re not one of those categories.
