W8 BEN Form - What is your e-mail request?

I have now received the following again on form w8:

"Please note the provided paragraph doesn’t apply to the services that you are applying on Zazzle and there may be another part of the paragraph that pertains to the work that is being performed. I can also confirm that your paragraph reference is currently higher than it should be. Please revise. "

I did not understand if it is a new policy to drive people away.

My paragraph is:
12 (3) article US - Italy treaty
0% rate of withholding
Royalties for the use of artistic work
Royalty payments for artistic work (designs) printed on a range of goods sold on Zazzle online web stores.

This has been going on for two months.
As you can read what Wandana sent me makes no sense.
What does Zazzle want?

“Please note the provided paragraph doesn’t apply to the services that you are applying on Zazzle and there may be another part of the paragraph that pertains to the work that is being performed.”

What does it mean? What other part of the paragraph?

“I can also confirm that your paragraph reference is currently higher than it should be.”

What to confirm? Zazzle must receive the exact information of what I do, and the information has been amply explained.
Evidently Zazzle does not want to pass my form, because the form is ok.

OK, replace article 12(3) with 12(2) as listed in the following table under Royalties Italy (don’t look at the yellow marking, did the shot for someone else). The rate is 0%. Just replace the article and resend, this should do the trick. The rest looks ok. Let me know! As a side note, this is more complicated than Italian bureaucracy, and we’re world champs in that.

@CapriWedding   Have you had a read of @Fiorenzo excellent thread https://community.zazzle.com/t5/share-your-tips-tricks/w-8ben-links-to-irs-documents-and-tips-for-form-editing/td-p/29492

If you’re on Facebook - you can join International Zazzlers United and ask for help with the wording maybe

I think “paragraph reference” refers to the article 12 paragraph 3 (from the US/IT tax treaty) - they perhaps mean it should be a different paragraph number?

(Not a professional w8BEN consultant :joy: so have no idea what they are talking about )

Yes, they probably expect paragraph 12(2) rather than 12(3) as written in my other reply. Other lists mention 12(2) (like the one I listed in my reply), although IRS mentions our kind of royalties in 12(3), and this is also the paragraph I always had in my own form and always got accepted. perhaps the one checking the form is using one of these lists circulating. here’s what IRS says:

I am grateful to you Fiorenzo, of course, I do exactly as you wrote, I resend it and let you know and your side note is very true! 😁

This should do the trick, you’ll see. I assume, by not giving away any info, Zazzle wants to be on the safe side and avoid troubles with people trying to sue them for giving away wrong information in the case of mistakes. You know how it works in the States. That’s why the American users manual of my Trans Am was triple the thickness of the European one in 3 different languages

@Fiorenzo   I’d started my reply probably at the same time as you but got interrupted by my cat :joy_cat:

LOL, I hear you, happens regularly here with my furry gremlins, especially since I’ve rescued the last pup. That brat got evicted from hell by Beelzebub himself. Here, for a smile. This is already an older pic, but it describes the battlefield well

Honestly, I think it’s 'cause of the mention of Z.

@Sara_H

Nu uh, cat is innocent, they always are. Probably provoked by the dog, dogs are instigators. Cat asked me to write this to you, since your cat says they don’t know the human alphabet, only cat-to-neeese. They contacted me thru cat-chat.
