This is what I found on the internet:

All Unicode emoji are in the public domain and therefore may be used for any purpose, including commercial use without the need to obtain any consent. 

Emoji Co. GmbH has registered trademarks in the dictionary word “Emoji.

I wonder, is it possible to create a design, saying Happy World Emoji Day? or do we say Happy World Leave Blank Day instead?😂

Hmmm ... according to this article below, commercial use is a no no, so proceed with caution here.

Thank you for your reply❤️, there is only 1 design for World Emoji Day at Zazzle and I won't make the second one lol Even the court thinks it is stupid, according to this article the court says this: 

That’s messed up. How messed up? The court says:

Plaintiff suggests that any person who sells a product depicting a familiar emoji is forbidden from using the one word that most closely describes the image depicted. Plaintiff’s right cannot be so expansive.

It's always better to err on the side of caution when it comes to IPs.

It goes both ways. As a designer, I have seen my share of stuff that makes me SMH (someone trying to copyright the pi symbol is the first thing that comes to mind).

I can't even confirm if the word emoticon is safe to use.
