Zazzle Content Review "Bohemian Grove"

I just had a design deleted for using Bohemian and Grove in the tags or description but I don't think the two words were placed together at least not on purpose.  I don't know for sure because it was deleted before I was able to check.   So be careful not to put these two words on the same product.  Maybe I did have them together.  But I would have never thought of putting them together as a phrase.  It was an unfortunate accident resulting in the deletion of that product.

'Please feel free to re-submit your design to the Zazzle Marketplace. The new product's title, description and keywords must not make any reference to "Bohemian Grove."  '

In the case of infringing tags and external texting that are not incorporated within the product, automatically removing all possible conflicting words and setting the design to private for review and resubmit under a new product ID (to avoid searches referring to the old infringing version leading to the new, adjusted variant) is a perfectly viable and legit way to solve the issue with the TM holder while still giving the designer the chance to correct the design without having to redo it from scratch. De facto, this way is no different than physically deleting the product and resubmitting a completely new one with adjusted content. That being said, trademark laws are a deep vicious jungle not only for us ordinary people/designers but also for skilled trademark lawyers.

wow thanks for the heads up on that. That is disturbing if it was just the combination of two random tags blending and your product was deleted.

I too had to google. I had no idea this was some sort of (presumably trademarked) men's club. The things you don't know until you get a product deleted....

Joining the club of the clueless, never heard of. The positive note is, you got a hint referring to that specific tag in your email, if I remember right this wasn't the case in older days? That being said, a softer approach in regard to conflicting tags and descriptive text would be nice. Either just deleting the conflicting words or setting the product private and review needed by resubmitting. An alternate solution would be a TM database made available for us designers here on Z, where we can check our words.

The tag info was in a follow up email.  The first email did not contain any info regarding the reason other than the usual vague message.  I wrote back asking for more info.  It would be so helpful if they would not delete the products so we could at least see the tags.  Then I could see exactly how the tags and description were written.  It would be very helpful to know if the two words were used together.  I can't know for sure how they were used the way they delete the item without giving us a chance to even look at it first. So if they could at least copy the tags, title and description for us so we could see what the problem was.  But ideally hiding it so we could delete the tags and submit for approval would be the best way.  But if for some reason that is not legally allowed it would be nice if they could explain that to us so we could understand why they just delete the items without letting us just fix them, as well as, see how the tags were used so we will know what not to do in the future and also know what other tags to fix and how to fix them.

This is why I strongly advocate for freezing or putting on hold disputed products.  Automatically deleting them is wrong.  It takes a lot of work to put these products on the marketplace and even more work advertising them.  For a mere mistake, everything is instantly deleted instead of freezing the products, contacting the designer and giving a certain number of days to correct it.  In my case, Zazzle content review made the mistake.  Instantly, all my products with the art were deleted.  Please put disputed products on freeze.

You don't think Zazzle would put a strike against our accounts when this happens. I know of horror stories where people accumulated too many infringement claims that resulted in their whole shops being removed and their accounts terminated.
