I am the intellectual property right holder yet my image was pulled anyway!

I created an image on NightCafe, an AI platform. It was my prompt, my words. I created a product using that image and Zazzle pulled it down. No questions, no investigation, just BAM! Gone! I have tried 3 times to have a dialogue with the Content Review Team but all I get is a canned response. I sent the link to the original image. It really frustrates me because there is no appeal, no review... I might as well be talking to a brick wall. I have been a designer on Zazzle since 2007 and it isn't the first time they pulled a image I created but it has been many years since the last time. If I can not get some kind of personal and individual reply rectifying this situation, I will explore my options with a lawyer... or does anyone have another suggestion.

Did the "canned responses" you got actually say the product was pulled because they believe the image is not yours or are you just assuming that's the reason?

More often than not, when someone posts about something being pulled on them, it turns out to be because of a tag they used, NOT the image, but the automated "canned" notices that are sent apparently don't offer any specifics leading people to believe its an IP issue with the image. If you can remember the tags you used, perhaps someone here can identify the one that might have caused this to happen.

They can also pull things that they feel violate any of their acceptable content policies without it having anything to do with IP rights.

Without seeing the image and tags or knowing what Content Review actually told you, I doubt there's much anyone can do to help you except maybe suggest a different means of contacting Zazzle. I would suggest though forgetting exploring your options with a lawyer. It's an empty threat as Z is under no obligation to host any product/image they don't want to.

Without limiting the foregoing, Zazzle and its designees shall have the right to remove, without prior notice, any Content that they believe may violate the Agreement, is subject to complaint, or is otherwise objectionable to Zazzle.

Without knowing what the content refers to I would suggest reviewing your product tags and description. Copyright infringement may be in the keywords used, rather than the image used.

Well it would be nice if they'd say it was due to the tags and since it was removed, I can't go back and see what the tags were. Let me go see.... Thank you very much

Yes... it was due to the tag "zentangle" which is a registered trademark. Had no clue!
