Unsurprising, and it's already come up before. And it's already come up with this same guy. What he is trying (twice now) to get copyright for is raw output from the AI. The US Copyright Office has said that the image must have a significant contribution from a human to qualify for copyright. What counts as "significant" is something that will probably be litigated in the future, possibly by folks in the movie industry. 

I find it weird that this didn't come up before AI because computer generated art has been around for a long time....fractals! Is there a true difference between inputting parameters in a fractal program and inputting prompts in an AI image generator? But I couldn't find any cases where somebody tried and failed to copyright a fractal image.
