After scouring all four of the links Zazzle provided, I found that you need to look in advanced settings in each store, as opposed to your profile. Took me about an hour.

I don't know if I like this so much.
If, for example, I sell business cards, every time a customer needs these they will come and buy them.
If there is a digital download it means selling the file and goodbye to any resales to the same person.
So, can you explain what would be the difference between you and a microstock site?

As with the dynamic of any open marketplace, there is no guarantee you will make another sale from the same customer – this is true of physical products as well as Instant Downloads. To this end, however, we do our best to get customers back to Zazzle – and shopping at your store – through our recommendations technologies. It is important to note, though, that even if we do our best to get the customer back to your store, it is really up to them if they decide whether or not to shop.
We believe we add value to the customer’s experience in several forms: We allow them to customize and preview their design using our RealView™ technology, we provide many opportunities for organic discovery by showing them recommended designs (from your store as well as based on their interests), we provide easy ways to transfer designs onto products that they want, we offer an easy to use design tool as well as expert design help on demand through Zazzle LIVE. If a customer downloads a digital file of your thank you cards.... is there anything to tell them this is a one time use license? What is to stop them from using this digital file every year from now till the end of civilization? 🙂
May I suggest that before they download the digital file that they be forced to at the very least OPEN the readme file or whatever it is you are going to use to explain the license use they are to abide to? This way they can't say oh well I never saw or read the limitations of the license to use this download.
I've seen this used in contracts like my homeowners insurance I had to redo recently. I was forced to read the limitations etc. and had to physically scroll the entire page before it would allow me to sign my homeowners insurance policy

Even when people read such licenses, there will always be those who will scoff at the legalities and do as they please. Will it deter some people? No doubt it will.
My own way, in the eventuality that I join in, might be to create designs specifically for download along with letting loose of those that haven't been good sellers. This way, it won't bother me quite so much to imagine overuse. However, the items I haven't sold much of may not have sold much because they don't have wide appeal. I'll have to contemplate these things.

Cheaters are gonna cheat. Even if you say that an image is one time only. Even if you make them read the rules. Even if you put DO NOT STEAL FOR OTHER USE, etc. etc. All they are going to do is say to themselves, "So are they gonna sue me? How? Why? Over a $ 3.50 card?" If someone knows they can get away with something without being held accountable, they will. I've had enough problems with people stealing my graphics on Amazon and on FB forums in the past. No way am I going to just make it easy by allowing this digital sharing.

We have to keep in mind most people don't understand the limitations of personal use. If they buy a template and use it for their event, then a friend says
"Oh, could you share that template with me? I'm planning an event"
They just "Of course, my friend! Just tell me the info and I'll fill it in, download and send you the file"
And they just don't realize that this is not allowed. They think because they are sharing with a friend or family, this is "personal use".

One way around that (would have to be implemented by Zazzle) could be a policy of no edits after purchase except through customer service. Allow them to fix a typo but don't allow them to change everything to fit a different event.

We will let the user know the limitations of the Download License throughout the purchasing process and upon receiving the personal use link to the Instant Download. We will consider potentially enforcing an ‘acknowledgement’ from the customer to confirm they have read the Download License terms.

Below is the entirety of the Download License as is written now. I think it's a bit ambiguous and even seemingly contradictory and could stand to be modified for clarity.
First, I think that "personal" and "commercial" are probably the two most common terms used re digital content on any platform. People are used to seeing "for personal use only" or "commercial use strictly prohibited" or "commercial use under the following terms" and such. If I'm looking for a graphic to use, the first thing I look for is that one simple line saying yes/no to commercial use. If no, I keep going, if yes, I'll find & read the terms and decide if they're right for my needs. My point is, though "commercial use" / "commercial purposes" has been used much throughout this thread it never appears in the actual DL. 3.2.5.9 mentions "... or distribute for profit" but that's it. It seems like 3.2.5.1 should be "commercial use strictly prohibited". It's just such a common word/term in matters of content distribution that it's really strange to not use it anywhere in the DL.
Second, 3.2.5.7 says use for "promotional purposes" is allowed but the terms don't define what exactly is meant by "promotional purpose". I ran into this myself sometime ago on another platform that said no commercial use but OK on promotional materials. I never was able to figure out where the line between the two is drawn. If you're a business and put a design on say a tote bag and then sell that tote to customers, that's commercial use since you're turning a direct profit from it. If you give those bags away instead to advertise your business and hopefully attract more customers, you're not turning a direct profit from them but in my mind, it's still a commercial purpose. Maybe it's just me but I find the difference between commercial & promotional very hazy and difficult to understand.
Next, 3.2.5.9 says you don't have the right to "... or otherwise distribute for profit" but 3.2.5.6 says you can use it on websites, blogs and e-books, all of which can be used as a means to generate profit. I'm especially surprised to see e-books specifically mentioned as an allowed use. Whether the author releases it for free or for profit, wouldn't that be re-distributing the content digitally?
Finally (I think), 3.2.5.8 says "... may be printed: (i) onto physical Products through the Site according to this Agreement ...". I am guessing the intent there is to say you agree to it being printed & sold on THE product it was made available for / published with. But the way it reads is we're giving permission to a customer to re-upload the image and have it printed on any other thing Zazzle offers. Ouch! That's no bueno. Is this really Zazzle's intent here or just poor wording?
3.2.5. When a User clicks the “Download” button on the Site to download Content utilizing Public Products that the Content-owner has chosen to publish for download, the User is granted the following licenses to use the Content (collectively, "Download License") :
3.2.5.1. In Social Media post(s), profile page(s) or as profile image(s);
3.2.5.2. In digital social/community communications, including but not limited to invitations, save the dates, and announcements;
3.2.5.3. In digital advertising, editorial and/or promotional projects, presentations (including film and video presentations), catalogues, posters, signage, packaging, and brochures;
3.2.5.4. In digital projects for school or university;
3.2.5.5. As decorative background on a personal computer, tablet or mobile device;
3.2.5.6. In digital publications, including web pages, blogs, and ebooks; and
3.2.5.7. Digital prints, posters and other reproductions for personal or promotional purposes.
3.2.5.8. The Uses specified in Sections 3.2.5.1 through 3.2.5.7 may be printed: (i) onto physical Products through the Site according to this Agreement, or printed by Users using personal printers, without further restriction; or (ii) onto physical versions using commercial printers subject to Section 3.2.5.9 hereof.
3.2.5.9. This Download License does not include the right to display the Content for download or export, resell, license or otherwise distribute for profit that Content, including, without limitation, through other print-on-demand services, and you hereby agree not to use the Content in any such manner that competes with Zazzle’s business.

This looks like the license for the stuff downloaded from the Create tool - geared toward people using it to make digital ads, announcements, web page banners, etc. So apparently, it's the same license for purchased digital content?

I also wanted to say but ran out of time -
I understand that licensing terms, no matter how clear they are written or how in-your-face they are presented, are not some magic protection from misuse & abuse, intentional or otherwise, of the content they apply to. Most times one has no way of knowing anyway if people are violating them.
My feeling is that terms are primarily for after-the-fact, so that when a violation is caught, you can conclusively prove it; nothing murky or left up to interpretation in the terms, no tricky legalese the average layperson wouldn't understand. Clear terms that the user has to click a box saying they read and agree to before downloading. So that when trying to take action against a violator, there is solid legal ground to stand on. They can't cop out with "that wasn't clear" etc...
And in this case, the terms aren't just between the provider (Zazzle) and the end-user (customers), Creators are also agreeing to those use terms for their content when opting in. Making it even more important that the terms are as clear and specific as possible.

I am bringing this here so it doesn't get buried on the last page - this is in reference to an answer James gave to questions from ColsCreations ....
ColsCreations asked Question #4: Would it be correct to assume Zazzle is going to have an "all sales FINAL" policy for digital downloads (NO refunds/credits on them) to prevent rampant abuse of this option?
And James answered:
"Customers know and trust Zazzle for our 100% Satisfaction guarantee. We will explore the best way to represent digital content during and after the initial beta test. As always, any exploits of our goodwill policy will not be tolerated. We seek to understand customer return motivations (e.g., % returned before download, canceled events, unexpected interactions with the published design (fonts are not interactive, etc.))"
My question is, does this mean the customer can buy the digital download - and then for some reason claim the event was canceled or give some other reason and then have it canceled/refunded? You can't return a digital file, that genie would be out of the bottle meaning they just got the artwork for free?
I hope this is not the case and I am misunderstanding this!

In my opinion, they should only refund if the customer did not download anything. After the refund, the access to download should be removed.

We are looking into making Instant Downloads so they are non-returnable / non-refundable. For the Beta, however, we might refrain from this to learn why customers might want to return and the motivations behind it along with other variables. This is still to be decided.

Thank you for answering so many questions!
I would just like to add my vote to the suggestion/feedback that customers only be allowed to customize the design BEFORE they download it (similar to what they do in the Zazzle Create feature). They can still download their design an unlimited number of times, but it's still the original one they bought and customized.

Unless there is a typo in their text, in which case I think they should be able to request to edit the design one more time, someone from Z would verify it and approve the new edit. I say this because I can already imagine very frustrated customers complaining "I edited and downloaded the file, then I realized there was a typo in my text, and Z did not allow me to correct it! **** YOU Z!!! ⭐ out of 5 stars review".

We are allowing all Creators the opportunity to ensure their stores are ready in preparation for the Instant Download beta test – which includes the opportunity to decide which product(s) you want to participate in the offering as well as modify incorrect / sub-optimal products using the product edit tool. They can't return the product. They just got the artwork for free. And when someone learns they can get one thing free that way, what are the odds they will do it again, knowing it will be free? Maybe they will spread the word to friends and family too - "hey just complain and ask for your money back and it's free!"
I want to "purchase" a new car using this method. "Buy" it outright, take it home, call up the dealership and get my full refund while keeping the car in my garage....what a deal!

Exactly! I've actually seen people recommend this very technique to get free stuff from other places that have wide open return policies like this! (not necessarily digital downloads).

I’m concerned that people will download an image once, then use it on all sorts of products (for their personal use) without creators getting any more commission, instead of using the transfer to other products feature. This is particularly relevant for large images (ie posters) and pattern tiles, which could fit on anything.

Our primary goal for the beta test is to learn and understand the impact of Instant Downloads. It is unlikely we will do a ‘splashy’ announcement during this holiday season; however, we do plan on a more prominent announcement of this offering at the successful conclusion of the beta test.

Also I immediately looked into this after receiving the email notice about it and saw that none of my stores were opted in, but now in the meantime it seems they've changed this to opting all stores in by default. So, that's pretty sneaky.

It is very possible that if you did not receive an email, it is because you are not subscribed to emails from your store. To adjust your email preference settings, you go to your account settings and select “Notification Preferences.”

Yikes- I’m so glad you pointed this out… I went and checked all my stores a couple of days ago and made sure the box wasn’t checked. I rechecked a moment ago and all but one had defaulted back to allowing the migration!

NOT COOL AT ALL, ZAZZLE. When this was announced, I looked and my store was unchecked. Thanks ONLY to this thread here, I looked again and it was checked. I really REALLY don't appreciate that.

I will be checking every day after that when I drink my morning coffee. Zazzle can be very buggy. Whether this is intentional or not, this type of mistake could be very costly if it results in bestsellers being deleted.
